Our team in the Public Entities sector is made up of professionals specialized in the most diverse branches of Public Law, with solid integrated and complementary work in litigation and advisory demands, in defense of our clients’ interests. We also work on the recovery of credits from public entities, especially the FPM, FUNDEB and FUNDEF, with the aim of guaranteeing their financial sustainability. In addition, we act strategically representing these public entities in claims before the Federal Court of Auditors, advising on tenders and contracts and defending municipalities in public civil actions, writs of mandamus and other claims involving public assets. In addition, our firm offers legal advice on the release of agreements in favor of public entities, as well as defending the interests of public managers and private individuals in actions for criminal liability or administrative improbity, providing complete support for the demands faced by managers, former managers and entrepreneurs. Our focus is on acting in all administrative and judicial instances, as well as working with the Supreme and Audit Courts, so that, in an agile, transparent and collaborative manner, we can achieve the best results for public management.
Main lines of action:
- Sponsorship of various tax theses aimed at recovering credits for public entities, such as those related to the transfer of the FPM, FUNDEF, FUNDEB and Health Funds;
- Acting in administrative and judicial proceedings for the formalization and release of government agreements;
- Legal services aimed at managers and also former public managers who perform – or have performed – functions in the most diverse bodies of direct and indirect public administration (autarchies, foundations, public companies and mixed-capital companies), especially defenses in writs of mandamus, popular actions, public civil actions;
- Legal advice on the criminal liability of public officials in crimes of responsibility;
- Legal advice in administrative improbity actions brought against public officials and/or representatives of companies that contract with the Public Administration;
- Advising the Public Administration to better adapt its regulations to Federal Law 14.133/21, which has represented a major transformation in government procurement practices and established comprehensive guidelines for more agile and transparent contracting processes in all spheres of government – federal, state, district and municipal;
- Advice and litigation in bidding processes for purchases, works, provision of services, obtaining administrative concessions and public-private partnerships;
- Advice and litigation on public contracts already signed, such as requests for economic and financial rebalancing of the contract and enforcement of unfulfilled administrative contracts;
- Advice and defense on accusations of committing crimes under the Bidding Law, whether in administrative or judicial proceedings;
- Administrative litigation before the Federal Court of Auditors and other administrative control bodies, including oral arguments;
- Legal advice on drafting or revising the Municipal Tax Code, as well as all related local legislation;
- Litigation in heritage listing matters;
- Consultancy and preventive law in Electoral Law, as well as legal advice for companies linked to the press, in addition to drafting opinions and acting in Electoral Judicial Investigation Actions (Aije) and Elective Mandate Impugnation Actions (Aime).
